TERMS & CONDITIONS


All orders for Advertising with the Island Times Magazine are subject to the Terms & Conditions specified herein, irrespective of any conditions or statements to the contrary in any purchase order, or other contract submitted by the Advertiser or Agent.

1. TERMS

Advertisers must accompany their contract with full payment on their first insertion. Payments will be paid to Island Times Magazine. Advertisements will not run as specified in agreement until payment terms have been met. Monthly payment are billed 30 days in advance of service specified on agreement. Payment must be made no later than 30 days from invoice date. If unpaid, a late charge of 1 1/2% per month or 18% annually will be added on the unpaid balance and monthly thereafter until paid. Advertiser agrees to pay all collection costs including reasonable Lawyer’s fees.

2. ADVERTISEMENT DESIGN

Only the first ad purchased will qualify for a free Ad Design. Free ad design is not included for the Real Estate Section promotion. Any recurring changes to the ad will be charged a design time of $35/hr. Additional ad design services are available upon request for $50/hr.

4. CANCELLATION

The first insertion for each calendar year is non-cancelable. Cancellations will only be accepted 2 weeks before issue date. A cancellation fee of 55% of the remaining balance of contract applies and must accompany the Advertisers cancellation notice for cancellation to be accepted. Publisher reserves the right to reject or cancel any Advertising at any time without liability.

5. CONTENT POLICY

Island Times Magazine is a full color publication. Only full color advertising will be accepted. Island Times Magazine reserves the right to not accept any Advertisement that is not appropriate content. All Advertisements built by Island Times Magazine are the property of  Island Times Magazine and cannot be used in any other advertising print medium without the sole consent of the Publisher.

6. CONTENT RESPONSIBILITY

It is the Advertiser's responsibility to ensure that the Island Times Magazine receives the necessary ad materials by the deadline specified on their contract. All graphics must be within the file size and dimension restrictions listed in this agreement. Advertiser and/or its agents may request changes to any advertisement it deems unacceptable. Such a request does not constitute a termination of this agreement and will not affect the enforceability of any of its provisions. Island Times Magazine shall not be liable for any error in any Advertisement unless contrary to the Advertiser's proof and notified before the magazine closing date of the issue in which the Advertisement is to be placed.  An Advertiser and/or his agency assumes full liability for all Ad content (including any text, representation, illustration, logo, sketch, map, word, label, trademark, or other copyrighted matter).

7. UPGRADING OF ADVERTISEMENT

After entering into this agreement, the Advertiser may request an upgrade of the advertisement space no later than ten business days prior to the mid-point of the agreement from the start date indicated on the front of the agreement. After entering into this agreement, the Advertiser may request an upgrade of the advertisement. No later that the ten business days prior to the mid-point of the agreement. The difference between the former advertising rate and the new advertising rate will be calculated and invoiced to the Advertiser/Sponsor accordingly. The Advertiser/Sponsor may not request a downgrading of advertising space during the tenure of the agreement. Any requested change to a development must be received in writing.

8. ADVERTISING PRODUCTION

All Camera Ready ads must meet the following specifications:
CMYK, 300 dpi resolution, no bleeds except full page ads. Full page ads require 1/4 inch bleed with 1/2 inch content margin to allow trimming. All ad copy will be provided by the advertiser and must be approved by the publisher of the Island Times Magazine before creating the ad.

9. PROOFS

Advertisers will receive a digital proof of their ad and must sign the approval form or state required changes. Final ad approval must be received before deadline date. No changes will be made to the ad after the deadline. The advertiser is responsible for submitting required content before ad content submission deadline. If the advertiser fails to submit the required content or does not approve the final proof before deadline, the ad will not run.

Agreement of terms:

The Advertiser hereby acknowledges that Advertiser has read all the terms and provisions set forth in this agreement, and agrees that such terms and provisions are a part of this agreement.
